1. Acceptance of Terms

By accessing, browsing, or purchasing from peaknootropics.org (the “Site”) or from Peak Nootropics in any form, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not access or use the Site or purchase any products.

2. Eligibility

By using Peak Nootropics, you represent and warrant that:

You are at least 21 years of age
You have the legal capacity to enter into this agreement
You will use the Site and products in compliance with all applicable laws and regulations
All information you provide is accurate, complete, and truthful

3. Research Use Policy

All purchases are subject to Peak Nootropics’ Research Use Policy, which is incorporated into these Terms of Service by reference. By purchasing from Peak Nootropics, you acknowledge that you have read and agree to the Research Use Policy. In the event of conflict between the Research Use Policy and these Terms of Service, the Research Use Policy controls.

4. Account Creation and Security

4.1 Account Information You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account.

4.2 Accurate Information You agree to provide accurate, current, and complete information during account registration and maintain such information as current.

4.3 Account Suspension Peak Nootropics reserves the right to suspend or terminate your account at any time, with or without cause, and without advance notice.

5. Orders and Pricing

5.1 Order Acceptance All orders are subject to acceptance by Peak Nootropics. Peak Nootropics reserves the right to refuse, cancel, or limit any order at any time, before or after confirmation.

5.2 Pricing All prices are subject to change without notice. Peak Nootropics reserves the right to correct errors in pricing at any time, including after an order has been placed.

5.3 Pricing Errors If a pricing error occurs (including through system malfunction or human error), Peak Nootropics reserves the right to cancel the order and process a refund or correct the price before charging your payment method.

5.4 Inventory While Peak Nootropics strives to maintain accurate inventory, errors may occur. Peak Nootropics reserves the right to cancel orders for out-of-stock items.

5.5 Order Cancellation You may request to cancel your order within 4 hours of placement. Orders that have been processed or shipped cannot be cancelled. Refunds will be processed in accordance with Peak Nootropics’ Refund Policy.

6. Payment

6.1 Payment Methods Peak Nootropics accepts Zelle, Crypto, PayPal, Venmo, and Cashapp. By providing payment information, you authorize Peak Nootropics to charge your account for the full purchase price, including shipping and applicable taxes.

6.2 Authorization You authorize Peak Nootropics to obtain information about your account from your financial institution and payment processor as needed to process your order.

7. Chargebacks

7.1 Chargeback Policy Fraudulent, abusive, or unjustified chargebacks may result in account termination and legal action. Peak Nootropics maintains the right to pursue damages for fraudulent chargebacks.

7.2 Supporting Documentation Peak Nootropics may provide evidence of customer authorization, order history, shipping confirmation, and delivery records to your payment processor or financial institution in response to chargeback disputes.

7.3 Account Termination Any customer who initiates fraudulent or unjustified chargebacks may have their account permanently terminated, and Peak Nootropics reserves the right to refuse service to that customer in the future.

8. Shipping and Delivery

8.1 Shipping Regions Peak Nootropics ships within the US. Peak Nootropics reserves the right to refuse shipment to certain addresses, regions, or countries based on legal or logistical considerations.

8.2 International Shipping For international orders, the customer is solely responsible for:

Understanding and complying with all local import laws and regulations
Paying all applicable customs duties, tariffs, and taxes
Obtaining any necessary permits or licenses to receive the shipment
Resolving any customs delays or confiscations

Peak Nootropics is not responsible for seized or confiscated shipments due to customs issues.

8.3 Shipping Timeframes Estimated delivery timeframes are provided for convenience only and are not guarantees. Peak Nootropics is not liable for delays caused by carriers, weather, customs, or other factors beyond our control.

8.4 Shipping Responsibility Responsibility for packages transfers to you upon shipment from Peak Nootropics’ facility. You assume risk of loss during shipping. Peak Nootropics will investigate lost or damaged shipments through the carrier, but replacement or refund terms will be determined on a case-by-case basis.

8.5 Lost or Damaged Packages If your package is lost in transit:

Contact Peak Nootropics with proof of loss (tracking information showing non-delivery)
Peak Nootropics will file a claim with the carrier
Reshipment or refund will be processed after carrier claim is resolved

Damaged packages should be photographed and reported to Peak Nootropics within [INSERT TIMEFRAME] of delivery.

8.6 Address Responsibility You are responsible for providing a complete, accurate shipping address. Peak Nootropics is not responsible for packages shipped to incorrect addresses provided by the customer.

9. Returns and Refunds

9.1 No Returns Accepted Peak Nootropics does not accept returns on any products, whether opened, unopened, used, or unused. All sales are final.

Because all Peak Nootropics products are labeled Research Use Only (RUO), we cannot verify product integrity, storage, or condition once a product leaves our facility. Therefore, no returns or refunds are available under any circumstances.

9.2 Damaged or Lost Shipments If your package arrives damaged or is lost in transit:

Replacement or refund will be processed after the carrier claim is resolved (typically 30-60 days)

Contact Peak Nootropics with proof (photos of damage or tracking showing non-delivery)

We will file a claim with the carrier

10. Warranties Disclaimer

Peak Nootropics makes no warranties regarding:

Merchantability of the products
Fitness for a particular purpose
Non-infringement of third-party rights
Quality, safety, or efficacy of products beyond third-party COAs
Accuracy, completeness, or reliability of product information on the Site
Uninterrupted or error-free access to the Site

All products are sold “AS IS” and “AS AVAILABLE.”

11. Limitation of Liability

Peak Nootropics shall not be liable for any:

Direct, indirect, incidental, special, consequential, or punitive damages
Lost profits, revenue, or business opportunity
Loss of data, goodwill, or reputation
Physical injury, death, or property damage
Claims arising from product use, misuse, storage, or handling

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, etc.) and whether Peak Nootropics was advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so this limitation may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Peak Nootropics, its owners, officers, employees, agents, and successors from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

Your use of the Site or products
Your violation of these Terms of Service or the Research Use Policy
Your violation of applicable law
Your infringement of any third-party intellectual property or other rights
Third-party claims related to your purchase or use of products

13. Intellectual Property

All content on the Site, including text, graphics, logos, images, product descriptions, and code, is the property of Peak Nootropics or its licensors and protected by copyright, trademark, and other intellectual property laws. You may view and print content for personal, non-commercial use only. Reproduction, modification, or distribution without permission is prohibited.

14. User Conduct

You agree not to:

Use the Site or products for any illegal purpose
Attempt to gain unauthorized access to the Site or systems
Introduce viruses, malware, or harmful code
Harass, threaten, or defame others
Resell products without authorization
Use products in violation of the Research Use Policy
Violate any applicable laws or regulations

Peak Nootropics reserves the right to terminate your account and refuse service for violations.

15. Affiliate Disclaimers

Peak Nootropics is not responsible for any claims, statements, recommendations, or representations made by affiliates, influencers, content creators, or third parties promoting Peak Nootropics products on any platform, including but not limited to social media, websites, videos, or other media.

Affiliate statements do not represent Peak Nootropics’ endorsement and may not reflect Peak Nootropics’ actual position or policies. Peak Nootropics does not endorse or verify any claims made by affiliates or third parties.

Any use of Peak Nootropics products must comply with the Research Use Policy regardless of any statements, recommendations, or claims made by affiliates or third parties.

Peak Nootropics reserves the right to terminate affiliate relationships, remove affiliate links, and pursue legal action if affiliates violate the Research Use Policy, make medical or health claims, promote products for human consumption, or otherwise misrepresent Peak Nootropics’ products or policies.

These Terms of Service, combined with the Research Use Policy and Privacy Policy, constitute the entire agreement between you and Peak Nootropics regarding your use of the Site and purchase of products.
